The trio on the appeal board who gave Everton four of their points back were three different individuals than the original independent commission.
Both the original independent commission and the appeal board were selected from the independent Judicial Panel, which the Premier League says comprises of a number of legal, financial and other experts. Members of the Judicial Panel are appointed by its independent Chair, Murray Rosen KC, who is an experienced barrister.
The original independent commission was chaired by Mr David Phillips KC (King’s Counsel, a senior trial lawyer), a barrister at Wilberforce Chambers who advises and litigates in a broad range of commercial matters including professional liability, regulatory, sports related matters and EU transport regulation, as well as mainstream commercial litigation. He was joined by His Honour Alan Greenwood, a Circuit Court Judge assigned to the South East and Mr Nick Igoe ACA (Associate Chartered Accountant) who has over 27 years’ experience as a finance director, working in that role for West Ham United between 1997-2012 and as chief financial officer for London Scottish International Limited between 2014-22 while also currently being a member of both the EFL Club Financial Review Panel and Sport Resolutions’ Panel of Arbitrators and Mediators.
Although seven of Everton’s nine grounds for appeal were dismissed by the appeal board, they concluded the original independent commission had “made legal errors” on two grounds.
